DEFINITIONS: These Terms and Conditions or Rental Agreement apply to the lodging and services provided through BeachNView Vacations, LLC. Or know as the “Agency”.The person signing and agreeing to the Rental Agreement is the “Guest”. The property is referred to as Home, and any person occupying or visiting the home is an “Occupant”. Agency reserves the right to modify these Terms and Conditions at any time by posting on the Agency’s website.

RESPONSIBLE PARTY: Guest must be at least 25 years of age and must be an occupant of the Home during the entirety of the reservation. Guest’s government issued I.D. must be sent in withsigned rental agreement. Guest assumes responsibility for the actions of all occupants and visitors to the Home. Agency may cancel the reservation at any time with full forfeiture if the Home is booked under false pretenses or if one of the occupants has previously breached Agency’s Rental Agreement. Guest will sign a lease agreement.

RESERVATION CONFIRMATION: Guest must agree to these Terms and Conditions and provide the specified payments. Within 24 hours of booking, Guest must complete the Guest ID and credit card verification, sign an e-sign agreement, including the names and email addresses of all adult occupants. All reservations are subject to review and agency approval prior to final confirmation and may cancel any reservation that does not comply with these requirements. Prices and availability are subject to change until the reservation is confirmed.

BACKGROUNG CHECK You will receive an email from Safely who will ask you to complete a fomr so they can complete a background check.

Receipt and Initial Payment

  • The guest agrees to an initial payment of 25% of the full rental amount to BeachNView Vacation LLC upon booking, which signifies full acceptance of these Terms and Conditions.

Remaining Balance

  • The guest agrees to have all balances paid in full 60 days prior to arrival for nightly rentals, and 90 days prior to arrival for monthly rentals. Guest will receive a reminder e-mail informing him/her of upcoming payment(s). If guest wishes to pay remaining balance with a different credit card than the one on file, the guest must contact BeachNView Vacations, LLC before balance is due.

Refunds

  • No refunds/discounts will be given for situations out of the control of BeachNView Vacations, LLC. These include, but are not limited to: government actions, adverse weather or beach conditions (excluding mandatory hurricane evacuation), road/building construction that may occur around or near any of our properties or in Panama City Beach, equipment malfunctions (such as pool/spa, A/C, appliances, TVs, cable, or Internet) while in residence, early departure or late arrival (shortened stays), or utility service disruption.

Hurricane Refund Policy

  • We offer full refunds for mandatory evacuations dates only. We suggest travelers insurance. However, if the guest cancels before or after mandatory evacuation dates, regular cancellation policies apply for cancellation policies). The guest also has the option to change dates. 

Housekeeping

Guest shall be responsible for excessive cleaning charges , subject to costs.

Maximum Occupancy

  • Each property specifies the number of adults and children allowed to stay as guests in the unit. We do not have extra beds or cots available. If the number of guests exceeds the specified number allowed, guests will be asked to leave without compensation or refund.

Children

Our properties are not child-proof, nor does BeachNView Vacations, LLC represent them as such. Thus, children are required to be supervised by an adult at all times. Amenities—such as furniture with sharp edges, games with small pieces, knives, cleaning products, pools/spas, and other examples known and unknown—pose safety issues for children. Guest claims understanding, acceptance, and responsibility for these risks upon booking. 

RULES

The Guest agrees to abide by all rules and regulations set forth by local laws.

The Guest agrees not to use the property for any illegal or commercial purpose, including but not limited to sub-leasing the property.  The Guest will not allow more than the maximum permitted if not agreed to prior to check-in.

BeachNView Vacations can refuse to allow the Guest into the property or ask the Guest to leave if they reasonably believe the Guest or any member of the Guest’s party are behaving illegally or that any damage is likely to be caused, has been caused, or is being caused as a result of the Guest behavior or any members the Guest has invited to the property.  If this occurs, BeachNView Vacations has no obligation to provide a refund of any payment the Guest has paid for the booking and will not be legally responsible for finding any alternative accommodation.

The Guest agrees to vacate the property by the check-out date and time specified in the reservation.

The Guest is responsible for any breakage or damage costs (or related costs) in or to the property – along with any extra costs that may result – which are caused by the Guest or any members of the Guest’s party.  The Guest agrees to pay for any damage not covered by the Damage Waiver protection.

The Guest must not hold events (such as parties, celebrations or meetings) at the property without the advance written consent of BeachNView Vacations. Any of these cases will allow BeachNView Vacations to refuse to allow the Guest into the property or ask the Guest to leave without providing a refund of any payment the Guest has paid for the booking.   If this occurs, BeachNView Vacations has no obligation to provide a refund of any payment the Guest has paid for the booking and will not be legally responsible for finding any alternative accommodation.

Some homes may have ring door bell cameras on the front doors. 

GARBAGE: Guest shall place all food scraps in the garbage and not sinks. All waste generated during the rental period must be disposed of in a lawful manner in trash bags and in the receptacles provided with bags tied off to discourage pests. Guest agrees to notify Agency of overflowing trash bins.

SMOKING: Smoking and vaping are prohibited anywhere in or near the Home. Decontamination and littering charges starting at $500 per day will be assessed and Guest will be subject to eviction as well as financially responsible for any damage including, but not limited to, stains, burns and the cost of odor remediation and potential relocation costs of arriving guests.

DRUGS: Use of illegal drugs in the Home or premises is prohibited and may result in immediate termination of the stay with no refunds. Marijuana may not be vaped or smoked inside the Home. Guest assumes all liability for death or injury from any edible marijuana products, pharmaceuticals or other drugs on the premises left on the property at check-out.

PETS / SERVICE ANIMALS: Pets are prohibited unless otherwise approved in writing with a signed Pet Addendum and deposit. If an unauthorized pet is found on the premises, Guest may and/or pet may be evicted and Guest is responsible to remedy all pet damages and the cost of remediation, including pet allergen remediation, flea remediation and reimbursement to Agency. This includes any refunds or costs necessary to relocate or compensate for the relocation of future guests until remediation is completed. Service animals, as defined pursuant to regulations under the Americans with Disabilities Act, are allowed to accompany Guests during their stay. Service animals must be individually trained to perform a task for the benefit of an individual with a disability. Animals providing emotional support, comfort or companionship are not service animals. Guests must notify Agency at the time of reservation if they will be bringing a service animal. Service animals may be removed if they are disruptive, aggressive, or not housebroken.

IMAGERY AND VIDEO: Guest and Occupants agree that they shall not, and will ensure that any visitor of shall not, record, film, video, or in any other way document any sort of media production for broadcasting or public use in any format in the Home, unless the Guest(s) and/or visitor has received prior express written consent of Agency.

TELEPHONES: Landline phones are not provided. Emergency medical, fire and police service can be called by dialing 911. 

TRANSIENT OCCUPANCY: Guest expressly acknowledges and agrees that this Agreement is for transient occupancy of the Home and that Guest does not intend to make the Home a residence or household.

OWNERS PROPERTY: Guest agrees not to access or use items in any areas that are the owners or Agency’s property, even if unlocked.

21 FIRE EXTINGUISHER: The Home is equipped with a minimum of one (1) fire extinguisher. It is the duty of the Guest to locate fire extinguisher, notify all other occupants of the location, and inform management immediately should the fire extinguisher be missing, or be less or become less than fully charged.

SMOKE DETECTORS: The Home has smoke detectors and they are believed to function properly at the time of rental. Guest will notify Agency immediately if a detector(s) is removed, missing, uninstalled, “chirps” or has a low battery condition.

Cancellation Policies

It is important to understand our cancellation policies.

  • Nightly
    • From initial booking date up to 61 days prior to arrival date
    • No refunds for cancellations within 60 days of arrival.BeachNView, LLC is not responsible for contacting the cancelled guest
    • *BeachNView Vacations, LLC regrets we are unable to waive any of the cancellation charges or rules above, whatever the circumstances (excluding mandatory hurricane evacuation). We recommend using travelers insurance.
  • Date Changes
    • If the guest would like to extend dates, we can do so at any time, as long as there is availability.
    • If the guest would like to shorten dates, we do not offer refunds for shortened stays.
    • If the guest would like to move dates entirely, we can do so as long as (a) the new dates are available, and (b) the change is over 30 days prior to arrival. Changes within 30 days, if approved, could incur a processing fee.

Miscellaneous Important Information and Disclaimers

  • Extenuating circumstances
    • In the event of circumstances beyond our control, we reserve the right to substitute comparable accommodations, if available.
  • Guest release
    • The guest signing the rental agreement assumes all responsibility for the actions and behavior of all guests, and agrees to follow the property rules written therein.

Monthly rental utilities

  • Monthly rental properties have a $175 limit for electrical costs per rental month. Any amount exceeding $175 will be deducted from the $1,000 security/damage deposit taken at the time of booking. Any unused amount will be refunded to the credit card on file.

Personal property

  • If personal property is left behind, and it is necessary for the items to be returned, the guest will cover the cost of postage, container(s), and shipping. If the guest does not claim a personal item within one week (7 days), the item will be tossed.

Disclaimers

  • The renter agrees BeachNView Vacations, LLC shall not be liable to guest, guest’s party, invitees, or any other person for loss, theft, or personal injuries or casualties sustained to any person or property on or about our rental premises. Guest shall hold BeachNView Vacations, LLC harmless and indemnified from and against all loss or damage occasioned by use, misuse, or abuse of any part of or fixture on the premises or surrounding areas; and from or against any omission, neglect, or default of the guest, his/her guests, or invitees. The renter acknowledges BeachNView Vacations, LLC is acting solely in the capacity of “agent” for the property owner, and assumes no liability thereunder.
  • If the guest defaults in the performance of any obligations contained herein, or fails to follow all rules and procedures, the guest and his/her party may be evicted with no compensation or refund. In addition, if any suit is brought against the guest, the owner/agent shall be entitled to recover all costs and expenses, as well as court costs and reasonable attorney’s fees. In the event of default, guest will be liable for a $200.00 processing fee, payable to agent immediately when default is disclosed or discovered. HOLD HARMLESS: Guest and occupants waives and releases and agree to hold harmless and indemnify Agency and the Homeowner against any and all claims, settlements, and damages (claims) arising from any cause during their stay, including off premises activities they participate in during their stay, including, without limitation, personal injury, property damage, expenses, judgments, fines, settlements and other amounts resulting from the Guest stay regardless of the nature of the accident, injury, or loss, other than claims arising from the gross negligence of BeachNView, its agent or employee. Guests and occupants also expressly recognize that any insurance for property damage or loss which the Homeowner may maintain on the property does not cover the personal property of Guests, and that Guests should purchase their own insurance if such coverage is desired.

Our units are licensed and operated under Florida Statutes and the State of Indiana.

Airport Codes:For Panama City Beach: ECP (Northwest Beaches) or VPS (Destin) ECP is the closest! 

For Indiana It is a home so parking is in the rear of the home in the driveway.

Parking for Panama City Beach: We will send you a parking pass ahead of time. Print out your parking pass and leave it on your dash at all times. One parking pass is included in your resort fee. An additional parking pass is extra. I will send you a separate email with all of these details so that you can have this taken care of in advance. Security can help you if you have any trouble so don’t hesitate to ask them. Parking Access is set to match the time frames above to ensure no overlap between Guests checking in and out on the same day. Luggage: Carts can be found on Level 3 of the Garage. Please DO NOT bring the cart inside the unit. They are large and they will damage the door and/or the walls if anyone attempts to bring the cart inside. Please unload and return the cart to Level 3 when you are done so that other guests can use it. 

Checking In: I will email you the access code for your stay shortly. This code is valid from Check-In Day 4:00 PM CST until 10:00 AM CST on Check-Out Day. 

If you leave after 10:00 and need back in, your code will not work. Please reach out to me if this happens, and I will get you back into the unit. 630-606-4068 Last, but not least, have a great time! Enjoy BeachNView and its amazing views, that’s why you booked it. Please also respect the property and avoid damaging anything so that it can be ready to go for the next guest behind you. I’m not picky about much, but I want to preserve this space so that it is always in perfect condition when you arrive. PS this is a non-smoking building. No smoking is allowed inside or out.
